{"id":14709,"date":"2025-02-07T10:23:07","date_gmt":"2025-02-07T15:23:07","guid":{"rendered":"https:\/\/whizkid.com\/a4pc\/?p=14709"},"modified":"2025-02-07T10:23:07","modified_gmt":"2025-02-07T15:23:07","slug":"good-news-in-the-court","status":"publish","type":"post","link":"https:\/\/whizkid.com\/a4pc\/2025-02\/good-news-in-the-court\/","title":{"rendered":"Good news in the court"},"content":{"rendered":"<p>This was great to see: The US District Court for the Middle District of Florida dismissed Novo Nordisk\u2019s lawsuit against <em>Live Well Drugstore<\/em>. Novo claimed that Live Well\u2019s semaglutide was adulterated, and that selling it violated Florida\u2019s Deceptive and Unfair Trade Practices Act. The court ruled, though, that the Food, Drug, and Cosmetic Act preempted the DUTPA. (APC had filed an <em>amicus<\/em> brief in the case, which the court considered.)\u00a0<\/p>\n<p>This is a big win on its own, but the decision is also good news for another case in which we\u2019ve filed an <em>amicus<\/em> brief: <em>Zyla Life Science v. Wells Pharma<\/em> of Houston, currently pending before the 5th Circuit. Of course Wells\u2019s attorneys informed the 5th Circuit of the Novo decision, which is not only germane to the case, it\u2019s an indication that courts are increasingly siding with compounding pharmacies in these lawsuits.<\/p>\n<p>The 5th Circuit heard oral arguments in <em>Zyla<\/em> back in September 2024, so hopefully this will spur the court into action and we\u2019ll get a decision soon.\u00a0<\/p>\n<p>By the way, those APC amicus briefs were made possible by our Legal Action Fund.
