It should; it\u2019s the <a href=\"https:\/\/a4pc.org\/news\/good-news-in-the-court?utm_source=hs_email&amp;utm_medium=email&amp;_hsenc=p2ANqtz-9OTqtf1VlF5grAyIJMY3qxaNNYO7nDwqu9xPbxiw4T2U01aHKFdS4C8bN8-4NY3poRcmqO\" data-hs-link-id=\"1\">second time in about a month<\/a> that the company needed to be reminded of that fact. This time it was in its case against Wells Pharmacy Network.<\/p>\n<p>Wells moved for summary judgement, pointing out a lesson Novo still hasn\u2019t learned: Private parties can\u2019t sue over the Food, Drug, and Cosmetic Act, and only the FDA has the right to enforce it.<\/p>\n<p>Heck, we\u2019ve been saying that for a while.
