Miller, RPh<br \/>APC President<\/p>\n<p><a href=\"https:\/\/whizkid.com\/a4pc\/2022-02\/cc-february-18-2022\/\">Last week<\/a> I gave a taste of what\u2019s called a SWOT analysis \u2014 something many of you, as business owners, know of. If you don\u2019t, the acronym stands for:<\/p>\n<ul>\n<li><strong>Strengths<\/strong>: characteristics of our alliance that gives it an advantage <\/li>\n<li><strong>Weaknesses<\/strong>: characteristics that place us at a disadvantage <\/li>\n<li><strong>Opportunities<\/strong>: elements in the environment that APC could exploit to its advantage <\/li>\n<li><strong>Threats<\/strong>: elements in the environment that could cause trouble for our alliance<\/li>\n<\/ul>\n<p>SWOT has both internal and external components. <em>Strengths<\/em> and <em>weaknesses<\/em> are usually considered internal, while <em>opportunities<\/em> and <em>threats<\/em> usually come from outside your business.<\/p>\n<p>For APC, our strengths are awesome. Our weaknesses are things we can overcome. Our opportunities are vast.  Our threats are real.<\/p>\n<p>Last week I talked about APC\u2019s strengths, and over the next three weeks, I\u2018ll address APC\u2019s weaknesses, opportunities, and threats, completing the brief SWOT analysis. <\/p>\n<p>I\u2019ll write about APC issues, but they also impact your business \u2014 both positively and negatively. You can reach him at <a href=\"mailto: drdave@keystonepharm.com\">drdave@keystonepharm.com<\/a>.<\/p>\n<\/div>\n<p><!-- THIS WEEK --------------------------------------------------- --><br \/>\n<!-- THIS WEEK --------------------------------------------------- --><\/p>\n<h1 class=\"thisweek\" style=\"clear: both; margin-top: 36px;\">\u27a4 This Week<\/h1>\n<p><!-- THIS WEEK --------------------------------------------------- --><\/p>\n<p><!-- ARTICLE BLURB ---------------------------------- --><\/p>\n<div class=\"story\">\n<h2 class=\"firsth2\">FDA concedes in MOU lawsuit<\/h2>\n<p>In a significant legal victory for pharmacy compounders, FDA has conceded that yes, it must conduct formal notice-and-comment rulemaking in order to implement an MOU with states regarding interstate shipments of compounded medications.<\/p>\n<p>The case, <a href=\"https:\/\/whizkid.com\/a4pc\/files\/2020-10-29_Pharmacies-Sue-Over-MOU.pdf\">Wellness Pharmacy v. Azar<\/a>, brought in federal court against the agency in 2020 by seven compounding pharmacies. APC was party to an <em>amicus<\/em> filing in support of the plaintiffs<\/p>\n<p>Last autumn, Judge Chris Cooper of the Federal District Court of D.C. <a href=\"https:\/\/whizkid.com\/a4pc\/files\/2021-09-21_MOU-Order.pdf\">ruled<\/a> that the way FDA created the MOU violated the law, and the agency cannot enforce it.\u00a0The MOU was remanded back to FDA, and the agency was told to \u201ceither certify that it will not have a significant economic effect on small businesses or prepare a regulatory flexibility analysis.\u201d<\/p>\n<p>On Wednesday, FDA responded by filing a <a href=\"https:\/\/whizkid.com\/a4pc\/files\/2022-02-22_Wellness-v-Azar-Status-Report.pdf\">status report<\/a> with the court saying it would suspend implementation of the MOU and do what it should have done in the first place: engage in a formal rulemaking process. That process, the agency said, may take \u201cseveral years\u201d to complete.<\/p>\n<p>\u201cWe\u2019re pleased that compounders\u2019 concerns and arguments have prevailed in this case,\u201d said APC President Dave Miller. \u201cWhile this litigation resulted from what we view as FDA overreach, we do support the agency\u2019s desire that pharmacies that ship the majority of their compounded medications out of state report those shipments. With this case settled, we\u2019re committed to work with FDA and Congress to enact an effective reporting framework that meets FDA\u2019s need for information and doesn\u2019t threaten patients\u2019 access to compounded medications. He was so appreciated by the community as an advocate of functional medicine that the Austin City Council proclaimed February 28, 2022 \u2014 Bill&#8217;s birthday \u2014 as Bill Swail Day.<\/p>\n<hr>\n<p><strong>Bubbly danger<\/strong>: Dissolvable, fizzy acetaminophen (aka <em>paracetamol<\/em>) contains a lot of salt \u2014 too much, in fact, <a href='https:\/\/www.escardio.org\/The-ESC\/Press-Office\/Press-releases\/Salt-in-soluble-paracetamol-linked-to-increase-risk-of-cardiovascular-disease-and-death'>according to a study published in the <em>European Heart Journal<\/em><\/a>. Researchers found it increased patients\u2019 risk of heart attack, stroke, heart failure, and death after just a year of use. The longer patients took the bubbly drugs, the higher the risk. The issue isn\u2019t the acetaminophen, but the additives that make it fizz.<\/p>\n<hr>\n<p><strong>What the people want<\/strong>: A full 86 percent of Americans surveyed <a href='https:\/\/endpts.com\/almost-9-in-10-americans-want-the-fda-to-explain-why-some-drugs-are-rejected-new-jama-survey-finds\/'>say they want to know why the FDA doesn\u2019t approve a drug<\/a> (and they\u2019re apparently confident they\u2019d understand the reasons).
